EU Approves Privacy Shield Data Agreement

On July 12, 2016, the European Commission approved the adoption of the Privacy Shield data agreement covering the transfer of personal data from the EU to the United States.  This agreement replaces the Safe Harbor data agreement which was invalidated last October by the European Court of Justice.

 

The new agreement provided guidelines and regulatory protections for compliance with the agreement.  U.S. companies will be required to self-certify with the U.S. Department of Commerce and publish their commitments to how personal data will be processed and how individual rights will be protected.  These commitments would then be subject to U.S. law and enforceable by the U.S. Federal Trade Commission.  A copy of the Privacy Shield Framework can be found here.

 

NuCompass is also in the process of implementing the controls and policies to be ISO 27001 certified which covers the requirements for data privacy and security internationally and beyond the EU Privacy Shield Agreement.
